Premises Liability (Slip and Fall Accidents)

A property owner may be legally responsible for injuries caused by slippery surfaces (spills, mopped or waxed floors, snow and ice, foreign substances) or falling hazards (holes, broken railings, uneven pavement).

If you suffered serious injury, we conduct a prompt and thorough investigation into the circumstances of your injury and the extent to which the property owner is liable for the harm you have suffered.

Product Liability

If the poor design or manufacturing defect of a motor vehicle, workplace machinery or consumer product led to lasting injury, contact us to determine if you have a viable lawsuit against the manufacturer.

Serious Injury vs. Minor Injury

Insurance companies and juries are reluctant to pay out except for big negligence resulting in substantial damages. We take personal injury cases resulting in death or severe injury (broken bones, brain trauma, spinal cord damage, lost limb, herniated disc). Our job is to document your losses and future needs, build a strong case for liability and convince the insurers that a jury would award more than the reasonable settlement we are seeking. If necessary, Dan Joseph is a fierce litigator who will take the case to court.

Auto Accidents

All auto accident cases revolve around the insurance. Hiring an inexperienced lawyer or trying to settle your own claim can substantially reduce your rightful compensation. And every dollar counts when you’ve been hurt and can’t work.

Do not talk to an insurance representative until you have talked to an attorney. If you suffered serious injury in a car accident, call the law firm of George & Joseph for a free initial consultation. Experienced trial lawyer Dan Joseph fights for the rights of accident victims in the Pittsburgh area including Westmoreland, Allegheny, Armstrong, Butler and Indiana counties.

In most car accident claims, the negligence is not disputed. If fault is an issue, we send professional investigators or accident reconstructionists to the crash site to preserve evidence and locate witnesses.

The insurance coverage is what will make or break your claim. In your initial consultation, we will ask you to bring in your auto insurance policy. Attorney Dan Joseph, who brings 40 plus years of experience to your case, will fully explain:

  • Full tort vs. limited tort – The type of insurance you purchased determines your right to sue for full damages.
  • Uninsured/underinsured motorist – Your auto policy pays if the other driver had no insurance, the minimum injury coverage or fled the scene (hit-and-run). How much UM/UIM coverage do you have?
  • Stacking – Pennsylvania law allows you combine the coverage from all vehicles you own, doubling or tripling the amount available. Insurance companies won’t volunteer this, and may fight it.
  • Subrogation – If you are covered by Medicare or private (ERISA) disability insurance (ERISA), you may have to pay them back from the proceeds of your settlement. We never settle without knowing what liens will be subtracted from your check.
  • Comparative negligence – A jury award or insurance settlement may be reduced by the percentage of fault attributed to you. If you are deemed more than 50 percent at fault, you cannot recover any damages.

We have represented car accident victims who suffered paralysis, broken bones, severed limbs, brain injury and other permanent or severe injuries. We contract with a registered nurse who assembles and reviews your medical records to support your claim. Mr. Joseph also consults with doctors, economists, vocational specialists and other experts to determine your future medical needs, lost earning capacity and the degree of disability. We also calculate damages for pain and suffering, and the loss of enjoyment of life from lasting injuries.

The law firm of George & Joseph will fight the insurance companies for every nickel you deserve, in settlement negotiations, in mediation or in front of a jury. Your best interests are our only concern. Contact our New Kensington office today for a free case evaluation.  We take no attorney fees unless we are successful in securing compensation for your personal injury.

Motorcycle Accidents

Four out of five motorcycle crashes result in serious harm to the operator or passenger. Our clients have suffered the worst types of injuries: closed head injuries (brain damage), spinal cord damage, disabling neck and back injuries, broken arms, legs or facial bones, and severe road rash or lacerations. Many are permanently paralyzed, require the amputation of mangled limbs or require reconstructive surgery and grueling physical therapy.

It is absolutely critical to talk to a lawyer before contacting an insurance agent or signing anything!  Most motorcyclists are woefully under insured. Medical bills alone can reach $200,000 or more, not to mention lost earning capacity, compensation for pain and suffering, and reduced quality of life. Mr. Joseph and his legal team pursue every source of insurance coverage to maximize the recovery of damages.

We know that motorcyclists are careful, prudent drivers precisely because of the risks they face from thoughtless and inattentive car drivers. Mr. Joseph is a skilled trial lawyer with over 40 years of experience breaking down complex accident re-creations for juries and insurance company negotiators to demonstrate the existence of negligence.

Truck Accidents

The law firm of George & Joseph has secured verdicts and settlements in a number of truck accident cases in western Pennsylvania. Our experienced attorneys can sort out complex issues of liability and know what to look for in the investigation – at the scene and behind the scenes.

If you suffered severe injuries or a family member was killed in a semi truck accident, we are aggressive in holding the trucking company accountable for the extensive injuries and personal losses.

Trial lawyer Dan Joseph has handled many truck wreck cases in 40 years of practice. Fierce and successful in the courtroom, he believes that cases can be won or lost before a trial even begins. He personally visits the scene of the crash and conducts a thorough investigation of all possible causes:

  • Truck driver negligence – Was the trucker speeding, tailgating, drifting across lanes or otherwise reckless or inattentive? We look at prior traffic citations or reprimands and interview witnesses.
  • Fatigue or substance abuse – We examine logbooks and other evidence that the trucker violated federal limits on hours behind the wheel without rest. Was the driver drinking, using pain meds or illegal stimulants?
  • Negligent hiring and training – Did the employer do a criminal background check? Did the driver have a valid CDL license and tractor-trailer training? (Our investigation revealed that one driver had his wife take the test for him.)
  • Vehicle condition and freight – We have the truck inspected for evidence of bad brakes or tires, and obtain maintenance logs. Was the truck overloaded? Was the cargo properly balanced and secured?

Tractor trailers are intimidating to other drivers, so jurors have a built-in bias against them. By law, commercial vehicles are heavily insured for bodily injuries or wrongful death. These work in your favor, but don’t guarantee that the trucking company and its insurance company will pay the claim.

You need an experienced truck crash lawyer who will fight to hold the driver, employer and insurer accountable for the devastation. We won’t settle your claim until we are sure that your medical, financial and personal losses are fairly compensated.

Find out where you stand.  Contact George & Joseph today for a free initial consultation, including home or hospital visits. If we take your case there are no attorney fees unless we recover compensation for you.
