These cases are often won or lost in the initial stages and pre-trial motions. Criminal defense lawyers Duke George and Dan Joseph use all ther 80 years of experience to challenge the state’s case if you are accused of driving under the influence of alcohol or drugs:

  • Did the officer have reasonable suspicion to pull you over or just a “hunch”? Did he make false conclusions from field sobriety tests? Did he follow department procedures? Did he ignore your constitutional rights? Does the dashboard video tell a different story?
  • We use toxicologists to fight the blood or breath tests. Was the sample properly drawn and analyzed? How long after your arrest was it taken? Was the device used to measure intoxication in good working condition?

A first conviction for DUI will not usually involve jail time, depending on your BAC (level of intoxication) and whether there was an accident. But it puts your driver’s license in jeopardy and sets you up for harsh penalties if you are arrested for drunk driving again within 10 years.

Many first offenders are eligible for Accelerated Rehabilitative Disposition (ARD) –  a pre-trial diversionary program that does not require the entry of a plea but allows you to keep the DUI off your public record and (usually) retain your license. If ARD is an option (it’s up to the D.A.), We can advise whether you should accept it or fight the charges.
